General Terms and Conditions


Close To My Heart Guarantee

Close To My Heart guarantees all its products to be free from manufacturing defects, and its parcel carriers guarantee against damage in transit. Studio J® users have 90 days from the date of purchase to return a defective layout and seek a reprint, or 15 days from date of shipment to contact Close To My Heart and initiate a claim of shipping damage with the postal carrier. User error is not covered by this guarantee.

Missing Items

Every order goes through many steps to ensure accuracy; however, an occasional error may occur. In the event that items are missing from your order, please contact Consultant Services and report the missing item(s). We will verify and correct the problem within two or three working days of your call. Please do not duplicate the request by contacting us more than the one time. If items are missing because the box was damaged, please refer to Shipping Liability policy. Missing items must be reported to Close To My Heart no later than 90 days from the date the order is shipped.

Exchanges

Close To My Heart will exchange any non-defective product (not including Studio J layouts) if it is returned unused and in resalable condition within 90 days of purchase. A reshipping fee of US$4.75 for US exchanges and C$10.00 for Canadian exchanges is charged. Close To My Heart does not offer cash refunds. To initiate an exchange, please contact your Close To My Heart Consultant. (If you are a Close To My Heart Consultant, you may call Consultant Services.) You may wish to insure the shipment, because Close To My Heart is not responsible for any packages that are damaged or lost in the mail.

Requests to Change or Cancel Orders

No changes or cancellations are allowed after an order has been submitted.

Shipping Liability

Once a shipment has left Close To My Heart, we are not responsible for delivery, damage, or loss. The carrier assumes this responsibility. Close To My Heart cannot guarantee the arrival time or condition of your shipment; however, if you do encounter a problem, Close To My Heart will help you resolve the situation with the carrier. Be sure to keep the damaged box or container, merchandise, packing materials, and any paperwork until the carrier advises you otherwise. Ownership, Copyright, and Reproduction

Studio J® Content

CTMH Co. holds the copyright to all Studio J® designs, including the website design, patterns, paper, and embellishments.

Uploaded Photos

Studio J users retain all rights to the photos they upload. Close To My Heart makes no claim to the copyright of uploaded photos.

Studio J Layouts

Layouts created using Studio J are derivative works of copyrighted Close To My Heart patterns and designs. As a condition of using the Studio J software, the user acknowledges and agrees to the following terms:

  • User agrees that no reproduction of layouts or other Studio J output is permitted by any means except through authorized use of the Studio J design software consistent with these Terms & Conditions. Layouts may not be copied or reproduced by scanning, photocopying or image capture, or by taking photographs where the layout makes up more than half of the total image. With a Studio J membership, JPG files are made available for reproduction and sharing in accordance with the conditions and restrictions stated below under “Studio J Memberships,” subheading “Studio J JPG Files.”
  • User agrees that Close To My Heart owns the copyright in layouts (or other Studio J output and projects), except photos (which user retains full rights to), and user expressly assigns all copyright in the layouts or other Studio J projects to Close To My Heart.
  • User agrees to only use photos which he/she she personally took, or which user has received express permission from the copyright holder to use. User indemnifies Close To My Heart from liability arising from photographs uploaded to Studio J.
  • User agrees that photographs containing pornography or unlawful violence are prohibited, and Close To My Heart may refuse to fulfill orders containing such images, and/or deny the user access to the Studio J software, without refund.
  • Close To My Heart will not use the projects users make with Studio J, except by permission.

Studio J Memberships

Studio J members have access to exclusive kits and patterns as well as the best Studio J pricing and other benefits. As a condition of being a Studio J member, the member acknowledges and agrees to the following terms:

  • Members receive 50% off of retail price.
  • Free shipping is available in a single monthly order of 4 to 20 layouts in the continental United States and 7 to 20 layouts in Canada, Alaska, Hawaii, Puerto Rico, Guam, and APO/FPO. This free shipment is via FedEx SmartPost in the continental US; USPS Priority Mail in Alaska, Hawaii, Puerto Rico, Guam, and APO/FPO; and Landmark in Canada. Studio J members who select an alternate shipping method will pay full price for that shipment. They will retain the credit for a free Studio J shipment through the end of that calendar month or until used on a separate shipment, whichever comes first.
  • Upon enrolling, the member will receive an email confirming the order and specifying how to redeem the membership. Redemption requires the creation of an online account, as well as the provision of a current credit card number.
  • Membership Auto Renewal: Upon enrolling, the member agrees to pay the membership price as well as monthly auto renewal for 3-month memberships and annual auto renewal for 12-month memberships. Member can cancel auto renewal by clicking on My Account in Studio J, selecting the Billing tab, and electing to cancel upcoming renewals.
  • Memberships that have already been processed cannot be refunded.
  • Upon expiration or cancelation of a membership, active (unpurchased) layouts created with member-exclusive content are no longer available for purchase unless membership is renewed. Archived purchased projects containing members-only content can be repurchased without a membership; however, such layouts cannot be saved as new projects and altered, then purchased. Projects without members-only content can be purchased regardless of membership status.
  • No minimum monthly purchase is required to retain an active membership, but monthly order privileges are forfeited if not used. Membership benefits do not accrue.
  • Each custom-printed layout comes with one free Memory Protector and JPG files.
  • Studio J JPG Files: JPG files of Studio J layouts are only available to Studio J members. The member acknowledges and agrees to the following terms governing use of Studio J JPG files:
    • JPG files of purchased layouts will be available to download for one week following purchase. If member does not download JPG files within one week of checkout, JPG files will require repurchase. Member will receive an email confirming when JPG files are available to download.
    • Since the JPG files are formed from Studio J layouts, all of the same copyright terms apply as are found under the heading “Studio J Layouts.”
    • There is no limit on the number of prints the authorized user may make of high-resolution JPG files.
    • Studio J images, including JPG files, may not be separated into constituent parts for reuse.

Studio J 5-Packs

5-packs are transferrable until applied to a Studio J order. As a condition of purchasing and using a 5-pack, the user acknowledges and agrees to the following terms:

  • After purchase, the user will receive an order confirmation email specifying how to redeem the 5-pack.
  • 5-packs are not tied to a specific account at purchase, and may be redeemed by the purchaser or given to another user. 5-packs are transferrable until applied to a Studio J order.
  • Each 5-pack contains a unique code that must be entered at checkout and is not replaceable in the event that it is lost or stolen. Risk of loss and title for 5-pack codes transmitted electronically pass from the purchaser upon electronic transmission to the recipient (including those in California and Virginia).
  • The 5-pack code is redeemable for a single order of up to 5 two-page layouts, 5 Memory Protectors®, along with free shipping and handling. 5-packs are not redeemable for cash or any other products.
  • 5-packs are redeemable only once. If the user orders fewer than 5 two-page layouts, remaining layouts are forfeited. If the user orders more than 5 two-page layouts, shipping and handling remains free of charge for up to 20 layouts; however, additional layouts over 5 are charged at the lowest price the user is eligible for. Additional layouts over 20 are charged shipping and handling.
  • 5-packs do not expire. 5-packs are non-refundable, except as required by law. Cash value of a 5-pack card equals 1/10 of one cent.

Return Policy

Returns

Close To My Heart does not offer cash refunds. When a product is defective, or if Close To My Heart has filled an order incorrectly, Studio J® customers can return the defective or incorrect product for a reprint. Such products must be returned within 90 days of the purchase date. To initiate a return, contact Studio J Support by emailing support@studioj.com. You may wish to insure the shipment because Close To My Heart is not responsible for any packages that are damaged or lost in the mail.

Damaged or Defective Products

One or more of the following conditions must be met in order for a project to be eligible for a return:

  1. A page has been damaged in shipping, by bending, tearing, folding, rubbing, or other such abuse in transit. Should this happen, the responsibility for the damaged or defective products fall on the shipping carrier, and thus products must be returned within 15 days of the purchase date rather than 90 days.
  2. Studio J page elements such as paper, My Stickease®, text, or embellishments are pixelated. (Uploaded photos are the responsibility of the user and do not qualify as a manufacturer’s defect.)
  3. Print quality suffers from manufacturer’s defects.
  4. An order has been incorrectly filled (i.e., a page is missing).

Always inspect your order shipment immediately upon receipt. Products damaged in transit must be reported within 15 days of purchase. Products suffering from manufacturer’s defect must be reported within 90 days of purchase. To initiate a return, contact Studio J Support by emailing support@studioj.com.

Approval of Projects

Studio J allows users to create custom content by uploading pictures and customizing layouts. By clicking “Approve,” the user approves all photos, page elements, and copy as-is. Projects that print as shown on the approval screen will not be eligible for returns. Close To My Heart is not responsible for user-generated content that has been approved. Examples of user error include but are not limited to: spelling mistakes, misplacement of text areas or embellishments, photos that are of insufficient quality, duplicated layouts, and embellishments that were not correctly colorized by the user.


Shipping Policy

Basic Shipping

Studio J® custom-printed layouts are shipped to the continental United States by Federal Express (FedEx), to the non-continental US by United States Postal Service Priority Mail, and to Canada by Landmark. Studio J layouts ship in a protected box that can hold 1 to 20 two-page layouts, plus accompanying Memory Protectors®. Standard shipping and handling per box is priced as follows:

Shipping Options

In the continental United States, Studio J customers have 4 shipping methods available through Federal Express (FedEx). These options are not available for destinations outside the continental United States. Upgrading your shipping method will not affect the in-house turnaround time of your order (typically 2 to 4 business days). In-house rush is not available.

Please keep in mind that upgraded shipping methods are guaranteed by the carrier, and Close To My Heart is not responsible for shipping delays after the order has left the warehouse. The shipping options are:

  • FedEx SmartPost: After leaving the corporate office, orders using this option typically arrive within 2 to 8 business days. SmartPost orders are delivered via the FedEx network but use the United States Postal Services (USPS) for final delivery.
  • FedEx Ground: After leaving the corporate office, orders using this option typically arrive within 1 to 5 business days, Tuesday through Saturday between 9:00 am and 8:00 pm.
  • FedEx 2nd Day Air: This option guarantees orders will arrive to most areas 2 business days after leaving the corporate office, Monday through Friday by 7:00 pm.
  • FedEx Standard Overnight: After leaving Close To My Heart’s corporate office, this option guarantees next-business-day delivery Monday through Friday by 3:00 pm to most US addresses; by 4:30 pm to rural areas.

Combining Classic & Studio Orders

Studio J orders cannot be combined with any other type of orders. Studio J layouts are processed and shipped separately from all other Close To My Heart products, with the exception of Memory Protectors included with certain qualifying orders.

E-mail Notification

When you place your order, your web browser will direct you to a printable receipt page. You will not receive an email receipt at this time; however, if you are shipping to the continental United States or Canada, you will receive an email notification sent from FedEx or Landmark when the order is shipped.
